We know he says he now has an account that was not originally his.
We know he says it was his brothers. We don't actually know whose it was or how he got it. That is not an accusation, just an observation.
We know the he says the accounts original owner was invloved in scamming issues. We do not know what these 'issues' were or really anything about them.
From this we know that according to him, he did not level the account himself, regardless of brothers, scamming and whatnot.
We know he is upset, presumably because he feels entitled to be able to use his brothers account, even though it is clear in the ToS that this is not allowed. I can understand that upset.
It is based, in part on the assumption that his brother owned the in-game content, such as toons and gear. What can be confusing is that even though your brother may have payed money and certainly spent time leveling his toons and equipping them, he does not actually 'own' any of it. It is not actually his to give away, legally speaking. Wierd, but true.
Game companies have sued players and players sued game companies about this in the past. So far all precedent, as far as I know, is that the game company created and therefore own all content. You are just paying to play in the environment, using the avatar that they have created, including all the ways they have made to customize that avatar. That is a choice you make. It is not actually legal for us to monetize that investment. It would be a bit like renting a car and selling it, in the current model.... Or in this case, having your brother rent a car, maybe hold up a convenience store in it, then give it to you and object when the car rental company takes it back.
I am not saying this ownership, copyright model is right or wrong. I am just saying it is the one you agreed to in order to play the game.
