how would one make such a device?
That would be considered botting as far as I know.
There are apps that allow you to set up an automated touch routine, this is botting and you can usually tell if a person is botting by telling if they are moving in the same direction every now and then or using the same skills always at the same time as before in the same order. But I think if you legit used a real life machine, like a little brush swiping your screen every 10 minutes, it would be considered not-botting and there wouldn't be any evidence it isn't you touching the screen anyways.
Its a bad idea. You run the risk of being banned and permenantly losing everything. Not really worth it when its AOK to simply touch the screen 6 times per hour.

But what if you just leave it over night that way, can't really develop an instinct to touch the screen every 10 minutes. No one can tell if you are actually touching the screen or not, therefore they have no right to ban you.

Unless you were referring to botting which is easily noticeable.

I made such a device using an old fan and some other things that I won't name, and did this on my rogue for about 3 weeks at the start of v4. I sat in the Sewers and got about 4 Hawkhurst Chests per night.. Unfortunately, the rogue was disabled for 2 weeks and I was messaged by OTM stating that the TOS doesn't ban botting specifically, which is why I spent so much time and effort making my own device, but instead ANY sort of non-player interaction. Good luck!

Ask them for evidence of botting or non player interaction, and don't tell them you use a machine :P

Automating the game in any way is botting. You run the risk of getting caught and banned.

Personally I have no problem with touching the screen 6 times per hour and often run multiple devices. I've even done this for more than 12 hrs per day. It's pretty easy and generous of OTM to allow you do do it. If I were you I wouldn't test the limits getting banned over small change. It simply isn't worth it.

I was going to say leave it on your face lol. But either way your chance of waking up and finding you dropped or traded your items away is pretty high.
